Regular bail tab hoti hai jab kisi ko arrest karke custody me already rakha gaya ho, aur wo court se release ki request kare. Anticipatory bail is type ka pre-emptive shield hai – jab kisi ko darr hai ki unpe FIR ho sakti hai ya arrest ki possibility hai, wo pehle se hi higher court se protective order le sakte hain.
Anticipatory bail normally serious misuse allegations, political rivalry, ya doubtful complaints ke context me maangi jaati hai. Court dekhती hai:
