Law kehta hai: employer ko past record, integrity, and usefulness genuine dhang se evaluate karna hoga. Ye backdoor punishment nahi ban sakta bina proper material ke. Courts dekhenge:

Employee writ petition ke through challenge kar sakta hai agar process arbitrary lagti ho. At the same time, Court rarely apni personal assessment type kar ke “ye employee bohot acha hai” nahi likhega; wo sirf decision-making fairness check karega.
Compulsory retirement basic discipline tool ho sakta hai, but misuse se service morale crash karta hai.
